What is an Electronic Invoicing Provider?

According to current legislation, an “electronic invoicing service provider” is a company that, upon authorization by its client, issues sales documents electronically using digital means, in accordance with applicable regulations, on behalf of the client.

The provider is required to hold a Suitability Authorization for software used in Electronic Sales Document Issuance Services (Y.P.A.I.S.).
To achieve this, it is recommended that the provider participate in a permanent five-member Suitability Audit Committee recognized by the Independent Authority for Public Revenue (AADE).
This committee is responsible for certifying the software used for Electronic Document Issuance.

The accounting records (documents) of liable entities may be issued using provider services through approved “Y.P.A.I.S.” software.
All invoices or retail sales documents that are issued and authenticated through the services of an electronic sales document issuance provider are considered electronic invoices or electronic retail sales documents respectively, and their issuance and authentication are governed by the provisions of Articles 14 and 15 of Law 4308/2014.

The issued document is made available to the recipient both in electronic form through the provider’s services and in printable form, upon request.
In particular, for each retail sale of goods or provision of services, the corresponding retail sales documents are printed and delivered to consumers together with the delivery of the goods or upon completion of the service.

Electronic retail documents must be verified by the provider, and their content must be immediately available for preview through the provider’s website before being delivered to the retail customer.

Furthermore, every document issued through the provider’s services must display the provider’s company name and website, and must include the authentication string, the Unique Registration Number (M.A.R.K.), and the document identifier.

Among other obligations, the provider is required to offer immediate access to the data relating to each client company with which it cooperates, both to the client company itself and to the competent services of the Greek Tax Authority (AADE) for tax audit purposes.
Specifically, the provider maintains an appropriate interface with AADE for retrieving invoice data of the companies it serves. This interface enables the immediate retrieval of all data of each document, based on the search criteria published on AADE’s website, until the end of the following calendar year after their issuance.

The provider is responsible for the accuracy and completeness of the data transmitted to AADE, as well as for compliance with applicable operational and technical rules. Document data is transmitted in real time from the date of issuance.

The provider must preserve document data and the corresponding authentication information for each client company in accordance with legal requirements and for the period specified by each user entity. Such preservation complies with the provisions of Laws 4308/2014 and 4174/2013.

The provider is obligated to maintain the confidentiality of all data obtained during its contractual relationship with the entities it serves. Disclosure or use of such data for personal benefit or for the benefit of third parties is strictly prohibited.

The provider has the following obligations:

To maintain sufficient technical staff and a comprehensive support network.
To define, document, and implement a security policy for the management of digital data.
    The security policy must be certified in accordance with the ISO 27001 standard.
To maintain adequate financial capacity throughout the provision of the Electronic Sales Document Issuance Services (Y.P.A.I.S.) for which it has received a Suitability Authorization.
To store and process all data related to issued documents within the European Union.

These obligations ensure the proper operation and the security of the digital data managed by the provider.
